Terms of Service

You must be at least 18 years old and able to form a binding contract to use fxFundedSim. By using the service you represent that you meet these requirements; that the information you provide is accurate; and that you are not barred from using the service under the laws of your jurisdiction, are not on any government sanctions or denied-party list, and are not located in a country or region subject to comprehensive U.S. sanctions or where the service is otherwise prohibited. We may restrict access from certain jurisdictions at our discretion.

fxFundedSim is an educational and competitive trading simulator. It is software and a game, not a trading, brokerage, or financial service. We may add, change, suspend, or remove features at any time. The service is under active development; features may be incomplete or change without notice.

Authentication is handled by our provider, Clerk. You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information, keep it current, and notify us promptly of any unauthorized use. One person, one account, unless we agree otherwise. We may refuse, suspend, or terminate accounts that violate these Terms.

• fxFundedSim offers a free tier and paid subscription tiers. Paid plans are billed in advance through our payment processor, Stripe, on a recurring basis (monthly or annual, as you select).
• Automatic renewal. Your paid subscription renews automatically at the end of each billing period at the then-current price, and your payment method is charged, until you cancel. We disclose the renewal terms and price before you purchase.
• Cancel anytime. You may cancel at any time from the in-app billing portal (“Manage subscription”). Cancellation stops future renewals; access continues through the end of your current paid period plus any stated grace window.
• Prices are shown exclusive of taxes unless stated; you are responsible for applicable taxes. We may change prices on a going-forward basis with notice; changes do not affect the period you have already paid for.
• Refunds and cancellations are governed by our Refund & Cancellation Policy.

You agree not to:

• cheat, exploit bugs, manipulate game state, or use bots, scripts, or automation to gain an unfair advantage or distort results, leaderboards, or competitions;
• reverse engineer, decompile, scrape, data-mine, or attempt to extract source code, market data, or the underlying datasets, except as permitted by law;
• interfere with, overload, or attempt to gain unauthorized access to the service, other accounts, or our systems;
• upload unlawful, infringing, hateful, harassing, or malicious content, or impersonate others;
• use the service for any unlawful purpose or in violation of these Terms or applicable law.

We may investigate suspected violations and may remove content, reset stats, void results, or suspend or terminate accounts.

Ranked duels, tournaments, clans, and leaderboards are skill-based features of the game. In-game rankings, “funded” status, simulated payouts, and any rewards have no cash value and are not real money or real prizes.

If we run any competition, promotion, contest, or giveaway that offers a real prize, it will be governed by separate official rules made available at that time, may require eligibility verification, and is void where prohibited by law. We may modify, suspend, or cancel competitions, and may disqualify participants who cheat, exploit, or otherwise violate the rules or these Terms.

You retain ownership of content you submit (e.g., handle, profile details, community posts, shared replays). You grant fxFundedSim LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use that content to operate, improve, and promote the service. You are responsible for your content and represent you have the rights to submit it. We may remove content that violates these Terms or the law.

The service — including its software, design, branding, logos, text, graphics, and compilation of data — is owned by fxFundedSim LLC or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

The AI Mentor is an automated educational feature and is provided subject to the Risk & Simulation Disclaimer. It can be inaccurate and does not provide financial advice or trading signals. We may set usage limits and may change or discontinue the feature.

We rely on third parties (including Clerk, Stripe, Discord, and others listed in our Privacy Policy). Your use of those services may be subject to their terms, and we are not responsible for them. Links to third-party sites are provided for convenience and are not endorsements.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT MARKET DATA IS ACCURATE, COMPLETE, OR TIMELY.

TO THE FULLEST EXTENT PERMITTED BY LAW, fxFundedSim LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless fxFundedSim LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these Terms or the law.

You may stop using the service and close your account at any time. We may suspend or terminate your access at any time if you violate these Terms or to protect the service or other users. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

Please read this section carefully — it affects your legal rights. First, contact us at dy1an.fx@fxfundedsim.org and we will try to resolve any dispute informally for at least 30 days.

If we cannot, you and fxFundedSim LLC agree that any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration on an individual basis, and not in a class, collective, or representative action. You and we waive any right to a jury trial. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. To the extent a claim is not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Fayette County, Kentucky, USA. Nothing here prevents either party from seeking injunctive relief or bringing a claim in small claims court.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and version above and, where appropriate, provide additional notice. Your continued use after changes take effect means you accept the updated Terms. We may also modify or discontinue the service at any time.

If any provision is found unenforceable, the rest remains in effect. These Terms (with the Privacy Policy, Disclaimer, and Refund Policy) are the entire agreement between you and us regarding the service. We may assign these Terms; you may not without our consent. Our failure to enforce a provision is not a waiver. We are not liable for delays or failures caused by events beyond our reasonable control.
